MyElena Terms of Service
Effective date: September 24, 2026
Last updated: September 24, 2026
These Terms of Service (“Terms”) are a plain-language agreement for the MyElena website and app.
By creating an account or using MyElena, you agree to these Terms.
1. WHO WE ARE
MyElena (“MyElena,” “we,” “us,” or “our”) operates myelena.online and the MyElena app.
The service lets a person post practical tasks they need help with and invite friends, family, or peers to a private support team. Team members can see those tasks and choose which ones they can help with.
Questions: privacy@myelena.online
2. WHAT MYELENA IS — AND IS NOT
MyElena is a coordination tool. It helps people organize ordinary help such as rides, meals, errands, visits, or household tasks.
MyElena is not:
- a doctor, nurse, hospital, clinic, or pharmacy
- medical advice, diagnosis, or treatment
- an emergency service
- a guarantee that someone will accept a task
- a paid caregiver marketplace in this version of the product
If you have a medical emergency, call local emergency services. Do not use MyElena for urgent medical help.
3. ELIGIBILITY
You must be at least 18 years old to use MyElena.
You must also:
- use a real email address you control
- provide accurate account information
- keep your login details private
- use the service only for lawful purposes
If you sign in with Google or Apple, you must have the right to use that account.
4. YOUR ACCOUNT
You are responsible for:
- activity that happens on your account
- the people you invite to a team
- the tasks and notes you post
Tell us right away if you think someone else used your account.
We may refuse, suspend, or close an account if we reasonably believe these Terms were broken, the account is unsafe, or the law requires it.
5. TWO WAYS PEOPLE USE MYELENA
A. Person requesting help
You may create a team, invite people you know, and post specific tasks.
You decide who is on your team.
You should only invite people who have agreed to hear from you.
B. Team member
If you accept an invitation, you can view tasks shared with that team and claim tasks you are willing to do.
Claiming a task is a personal commitment between you and the person who posted it. MyElena does not supervise the help and is not a party to that arrangement.
6. TASKS AND TEAM RULES
When you post or claim a task, you agree that:
- the task is practical help, not medical care
- you will not post anyone’s private information without permission
- you will not post content that is illegal, threatening, harassing, sexual, or hateful
- you will not use the team list to spam people
- you will not pretend to be someone else
- if you claim a task and cannot do it, you will update or release it when you can
A claimed task does not create employment, a professional care relationship, or insurance coverage through MyElena.
7. INVITING OTHER PEOPLE
You may invite only people you know and have a good reason to include.
You must not:
- add someone without a real connection to the person who needs help
- scrape or export team contact lists for other uses
- invite children under 18
The person who owns the team can remove members. A member can leave a team.
8. YOUR CONTENT
“Content” means anything you submit: profile details, team names, task text, notes, and similar material.
You keep ownership of your Content.
You give MyElena a limited licence to store, display, and transmit that Content only as needed to run the service. For example, we show a task to the team you chose and send notifications about it.
You are responsible for your Content. Do not post:
- medical records or health files
- payment card or banking details
- government ID numbers
- another person’s private information without consent
- anything you do not have the right to share
We may remove Content that breaks these Terms or creates a safety or legal risk.
9. NOTIFICATIONS
If you create an account, we may send:
- emails about your account, invitations, and tasks
- push notifications, if you allow them on your device
These messages are part of how the product works. You can turn off push notifications in your device settings. You can ask us to stop emails that are not needed to operate your account.
10. ACCEPTABLE USE
You agree not to:
- break the law
- try to access another user’s account or data
- probe, scan, or disrupt the service
- upload malware
- use automated tools to create accounts or scrape data
- use MyElena to sell services, advertise, or recruit without our written permission
- use MyElena to provide regulated health care or emergency dispatch
11. OUR INTELLECTUAL PROPERTY
MyElena’s name, logo, design, software, and written materials belong to us or our licensors.
You may use the service for its intended purpose. You may not copy, reverse engineer, or resell the product except as the law allows.
12. SERVICE AVAILABILITY
We try to keep MyElena available, but we do not promise uninterrupted or error-free service.
Features may change. We may add, pause, or remove parts of the product. We may perform maintenance.
We are not responsible for:
- a team member who does not complete a task
- the quality or safety of help given in person
- loss caused by you sharing too much information in a task
- outages of Google, Apple, email, or other third-party services
13. DISCLAIMER
The service is provided “as is” and “as available.”
To the fullest extent allowed by Canadian law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms limits rights that Canadian consumer-protection law does not allow you to waive.
14. LIMITATION OF LIABILITY
MyElena is a communication tool. Help arranged through the app happens between users, not as a service we perform.
To the fullest extent allowed by Canadian law:
- we are not liable for personal injury, property damage, missed care, or other harm that happens when users meet or help each other
- we are not liable for indirect, incidental, special, or consequential damages
- our total liability for any claim relating to the service is limited to CAD $10 or the amount you paid us in the previous 12 months, whichever is greater
This section does not limit liability that the law says cannot be limited, including liability for fraud or for death or injury caused by our own negligence where such a limit is not permitted.
15. INDEMNITY
If your use of MyElena, your Content, or your invitations causes a claim against us, you agree to cover reasonable costs we incur because of that claim, to the extent allowed by law. This does not apply if the claim is caused by our own misconduct.
16. ENDING THE SERVICE
You may stop using MyElena at any time. You may ask us to delete your account by emailing privacy@myelena.online.
We may suspend or end access if:
- you break these Terms
- we reasonably believe there is fraud, abuse, or a safety risk
- we stop offering the product
After an account is closed, we handle remaining data as described in the Privacy Policy.
17. CHANGES TO THESE TERMS
We may update these Terms. We will change the “Last updated” date at the top.
If a change is significant, we will try to notify you by email or in the app. If you keep using MyElena after the update, you accept the new Terms. If you do not agree, stop using the service and request account deletion.
18. GOVERNING LAW
These Terms are governed by the laws of Canada and the federal laws of Canada that apply.
If a dispute cannot be resolved informally, the courts of Canada will have jurisdiction, subject to any rights you have under mandatory consumer-protection law in your province or territory.
19. GENERAL
If one part of these Terms cannot be enforced, the rest still applies.
If we do not enforce a rule right away, we can still enforce it later.
These Terms and the Privacy Policy are the full agreement between you and MyElena about the service.
